INFORMATION ON THE PROTECTION OF YOUR PERSONAL DATA

Personal data collected and processed by Baymak Makina Sanayi ve Ticaret A.Ş. ("Baymak" or the "Company") are under the protection of our company. Personal data are processed by Baymak within the scope of this Clarification Text in accordance with Law No. 6698 on the Protection of Personal Data ("LPPD") and its secondary regulations and other legislation on the protection of personal data.

Pursuant to the LPPD, personal data means any information that renders you identified or identifiable. Your personal data processed by the Company, the purposes of their processing, the groups of recipients to whom they can be transferred, the method of collection, its legal basis, and your rights regarding such personal data are set out below.

A.I. WHICH OF YOUR PERSONAL DATA ARE PROCESSED?
If you visit our website, the following personal data can be processed;

  • Your Identity Information: Name, surname, and Turkish ID number,
  • Your Contact Information: Email address, phone number, cell phone number, and address details,
  • Information on Transaction Security: IP address details, website log-in and log-out details, and cookies details.

A.II. PURPOSES OF PROCESSING YOUR PERSONAL DATA
Your personal data can be processed for the following purposes in accordance with the relevant legislation;

  • Evaluation of requests and suggestions filed by users,
  • Carrying out communication activities,
  • Fulfillment of obligations arising from Law No. 5651,
  • Retention of your information that must be kept in accordance with the relevant legislation; copying and backing up to prevent information losses; ensuring the consistency of your information; taking the necessary technical and organizational measures for the security of our networks and your information,
  • Fulfillment of legal obligations required or mandated by legal regulations with regulatory and supervisory institutions, execution of legal proceedings and legal processes.

A.III. TRANSFER OF YOUR PERSONAL DATA
Your personal data can be disclosed, if requested by the relevant legislation, to the judicial authorities or law enforcement agencies to the extent required by the purposes set out under the heading A.II. of this Clarification Text within the scope of the provisions of the LPPD regarding the transfer of personal data

A.IV. LEGAL GROUNDS AND COLLECTION METHOD OF PROCESSING PERSONAL DATA
Your personal data obtained through electronic media during your visit to our website is processed by automated or non-automated means for the above-mentioned purpose, based on the reasons of lawfulness listed in Articles 5 and 8 of the Law and listed below.

  • As stipulated in the legislation to which Baymak is subject,
  • Data processing being necessary for Baymak to fulfill its legal obligations,
  • Being made public by you,
  • Data processing being necessary for the establishment, exercise, or protection of any right,
  • Processing of data is necessary for the legitimate interests pursued by Baymak, provided that this processing shall not violate your fundamental rights and freedoms.

B.I. WHICH OF YOUR PERSONAL DATA ARE PROCESSED?
The following personal data can be processed within the scope of your visit to Baymak campus;

  • Your Identity Information: Name-surname, Turkish ID number/Tax ID number, passport number, date of birth, marital status,
  • Your Contact Information: Phone number, email address,
  • Your Information on Physical Space Security: Visitor entry and exit registration information, camera footage,
  • Your Other Information: Vehicle license plate information.

B.II. PURPOSES OF PROCESSING YOUR PERSONAL DATA
Your personal data can be processed for the purpose of ensuring physical space security in accordance with the relevant legislation if you visit the Company campus.

B.III. TRANSFER OF PROCESSED PERSONAL DATA
Your personal data can be disclosed to judicial authorities and law enforcement agencies to the extent required by the purposes set out under heading B.II. within the scope of the provisions of the LPPD regarding the transfer of personal data.

B.IV. LEGAL GROUNDS AND COLLECTION METHOD OF PROCESSING PERSONAL DATA
If you visit the Company's campus, the personal data obtained from you physically, in writing, verbally, or through CCTV cameras is processed by automatic or non-automatic means for the above-mentioned purposes, based on the reasons of lawfulness listed in Articles 5 and 8 of the LPPD and specified below.

  • Processing of personal data of the parties of an agreement is necessary, provided that it is directly related to the establishment or performance of the agreement,
  • In case of actual impossibility, if you are unable to provide your consent or if data processing is necessary for the protection of the life or physical integrity of the person whose consent is not legally valid or of another person,
  • It is necessary for the Company to comply with a legal obligation,
  • Data processing being necessary for the establishment, exercise, or protection of any right,
  • Processing of data is necessary for the legitimate interests pursued by the data controller, provided that this processing shall not violate the fundamental rights and freedoms of the data subject.

C.I. WHICH OF YOUR PERSONAL DATA ARE PROCESSED?
The following personal data is processed within the scope of your relationship with Baymak;

  • Your Identity Information: Name-surname, parents name, Turkish ID number/Tax ID number, passport number, nationality, driver's license, date/place of birth, marital status,
  • Your Contact Information: Address details, telephone number, email address, registered electronic mail address (REM),
  • Your Professional Experience Information: Occupational information, diploma information, on-the-job training information, certificates,
  • Your Financial Information: Bank account details, bank/account/card details,
  • Your Data of Special Nature: Information on disability status,
  • Your Other Information: Vehicle license plate information.

C.II. PURPOSES OF PROCESSING YOUR PERSONAL DATA
Your personal data can be processed for the following purposes in accordance with the relevant legislation:

  • Carrying out current account card opening and current account viewing processes,
  • Carrying out private pension transactions,
  • Being able to follow the supplier personnel,
  • Storing and recording supplier personnel information in the system,
  • Creating call center records,/li>

  • Creating solution center complaint records,
  • Making calls for additional warranty sales,
  • Giving CRM access authorization to supplier call center employees,
  • Tracking vehicle/driver information and monitoring the material logistics process,
  • Evaluating order forms,
  • Issuing waybills,
  • Ensuring coordination with maintenance and supply companies,
  • Executing agreement and negotiable instrument review processes,
  • Preparing occupational accident reports for work accidents,
  • Managing the qualification process for supplier personnel,
  • Making service current account and subsidiary industry current account payments,
  • Conducting current account reconciliations,
  • Carrying out operational activities.

C.III. TRANSFER OF YOUR PERSONAL DATA
Your personal data can be transferred to authorized persons, institutions and organizations, business partners, and suppliers in the country to the extent required by the purposes set out under heading C.II of this Clarification Text within the scope of the provisions of the LPPD regarding the transfer of personal data within the country and abroad.

C. IV. LEGAL GROUNDS AND COLLECTION METHOD OF PROCESSING PERSONAL DATA
Baymak processes your personal data obtained from our business partners, directly from you during your employment in our Company, or from legal authorities, via internet, telephone, email, and physical means, in written, verbal, and electronic media, by automatic and non-automatic means, for the purposes stated above, based on the legal basis set forth in Articles 5, 6, 8 and 9 of the LPPD and specified below.

  • Processing of personal data of the parties of an agreement is necessary, provided that it is directly related to the establishment or performance of the agreement,
  • It is necessary to comply with a legal obligation,
  • Data processing being necessary for the establishment, exercise, or protection of any right,

Your special categories of personal data are collected, stored, and processed based on the legal basis of obtaining explicit consent.

D.I. WHICH OF YOUR PERSONAL DATA ARE PROCESSED?
The following personal data is processed within the scope of your relationship with Baymak;

  • Your Identity Information: Name-surname, parents name, Turkish ID number/Tax ID number, marital status, date of birth, place of birth,
  • Your Contact Information: Phone number, address information, email address,
  • Your Financial Information: Invoice, bill, and check information, invoice and debt information, financial performance information, collection risk information, credit and risk information, bank account card information,
  • Your Other Information: Shopping history information, information obtained through campaign activities, order information.

D.II. PURPOSES OF PROCESSING YOUR PERSONAL DATA
Your personal data can be processed for the following purposes in accordance with the relevant legislation:

  • Conducting the VAT refund process,
  • Checking the signature circular,
  • Conducting market research for dealers,
  • Filling out the Private Pension System form and carrying out the related process,
  • Displaying dealer information on our website,
  • Carrying out risk management processes of dealers,
  • Forwarding shipment information.

D. III. TRANSFER OF PROCESSED PERSONAL DATA
Your personal data can be transferred to authorized persons, institutions and organizations, business partners, and suppliers in the country to the extent required by the purposes set out under heading D.II of this Clarification Text within the scope of the provisions of the LPPD regarding the transfer of personal.

D. IV. LEGAL GROUNDS AND COLLECTION METHOD OF PROCESSING PERSONAL DATA
Your personal data are collected verbally, in writing, or electronically from you, our business partners, and legal authorities during the establishment of your legal relationship with our Company and the continuation of such relationship, through the website, various agreements, electronic mail tools, and via the channels of written or verbal communication with our Company.

Your personal data collected in this context is processed based on the legal basis, set forth in Articles 5, 8, and 9 of the LPPD and specified below.

  • Processing of personal data of the parties of an agreement is necessary, provided that it is directly related to the establishment or performance of the agreement,
  • It is necessary to comply with a legal obligation,
  • Data processing being necessary for the establishment, exercise, or protection of any right,
  • Processing of data is necessary for the legitimate interests pursued by the data controller, provided that this processing shall not violate the fundamental rights and freedoms of the data subject.

Baymak processes the following personal data;

Your personal data obtained within the scope of your relationship with Baymak are processed for the purposes set out below.

  • Carrying out sales and marketing processes and preparing sales reports,
  • Conducting the field testing process,
  • Carrying out the processes of keeping and reviewing log records,
  • Carrying out the follow-up and development of high-level business relations,
  • Conducting the warranty process,
  • Coordinating social media complaints,
  • Fulfilling the decisions of the Consumer Arbitration Committee,
  • Carrying out the expenditure voucher use process,
  • Establishing contact with end customers,
  • Carrying out processes related to the organization of events and the delivery of promotions,

  • For the fulfillment of a legal obligation,
  • Processing of personal data of the parties of an agreement is necessary, provided that it is directly related to the establishment or performance of the agreement.

  • Your Contact Information: Phone number, email address, address details, social media accounts, registered electronic mail address (REM),

F.II. PURPOSES OF PROCESSING YOUR PERSONAL DATA
Your personal data obtained within the scope of your relationship with Baymak are processed for the purposes set out below.


  • Keeping the potential customer follow-up list after the fairs,
  • Carrying out high-level business relations and their follow-up process,
  • Creating potential customer lists within the scope of sales and marketing activities.

F.III. TRANSFER OF YOUR PERSONAL DATA
Your personal data is disclosed to in-house teams and group companies abroad within the scope of the provisions of the LPPD regarding the transfer of personal data, to the extent required by the purposes set out under heading F.II of this Clarification Text.

Your personal data obtained within the scope of your relationship with Baymak are processed for the purposes set out below.

  • Carrying out the process of responding to letters received from judicial and administrative authorities,

Your personal data is collected, stored, and processed during the job application that you have made directly to our Company or through our business partners via Internet, telephone, and email, in written, verbal, and electronic media for the purposes stated above, based on the legal basis set forth in Articles 5 and 8 of the Law and specified below.

  • For the fulfillment of a legal obligation,
  • Processing of personal data of the parties of an agreement is necessary, provided that it is directly related to the establishment or performance of the agreement,
  • Processing of data is necessary for the legitimate interests pursued by the data controller, provided that this processing shall not violate the fundamental rights and freedoms of the data subject.

You may exercise the following rights by applying to our Company through the methods in the "Contact" section of this Clarification Text.

  • To learn whether your personal data are processed or not
  • To request information as to if it has been processed,
  • To learn the purpose of the processing of your personal data and whether these personal data are used in compliance with the purpose,
  • To know the third parties to whom it is transferred in the country or abroad,
  • To request the rectification of the incomplete or inaccurate data, if any,
  • To request the erasure or destruction of your personal data within the framework of the conditions stipulated in the LPPD,
  • To request reporting of the operations carried out pursuant to your rights to rectification, erasure, and destruction mentioned above to third parties to whom personal data have been transferred,
  • To object to the occurrence of a consequence against you by analyzing your personal data processed solely through automated systems,
  • To claim compensation if you suffer damage due to the processing of your personal data in violation of the relevant legislation.

You can deliver your questions and requests regarding your personal data with a petition prepared in accordance with the requirements set forth in the Comminuque on the Principles and Procedures for the Request to Data Controller to Baymak Makina San. ve Tic. A.Ş. Tuzla/ ISTANBUL in person with your identification or send it through a notary public. In addition, you can send it to the registered electronic mail (KEP) address baymak@hs03.kep.tror to the electronic mail address info.kvkk@baymak.com.tr by using secure electronic signature and mobile signature or via the electronic mail address in our company system, which has been previously notified to our company by you and confirmed by us.

This Clarification Text shall be effective as of the date of its publication by Baymak. The Company may amend this Clarification Text at any time, if necessary. Amendments to be made by the Company shall become effective upon the publication of the Clarification Text on www.baymak.com.tr.
